This Petition under Section 11 of the Arbitration and Conciliation Act, 1996 ("Arbitration Act"), seeks appointment of an Arbitrator to adjudicate upon the arbitral disputes arising out of the Agreement dated 4th March 2014 referring to arbitration in paragraph 7.

Both Advocates are unable to arrive at a common name for appointment of an arbitrator and leave it to the Court. 3.
Therefore, I pass the following order:
(a) I hereby nominate Mr Swanand R. Ganoo, an Advocate of this Court, as Sole Arbitrator. His contact details are as follows: Mobile No. 9869765529, Email Id: 10th April 2024
11-ASARP-199-2023.DOC swanandg@gmail.com and office Address: Office No.9, 1st Floor, Rohit Chambers, Janmabhoomi Marg, Fort, Mumbai - 400001. He shall adjudicate the disputes between the parties that are subject matter of the present Petition.
(b) The Arbitrator is requested to file his disclosure statement, as per Section 11(8) under section 12(1) of the Arbitration Act, within four weeks with the Prothonotary and Senior Master and provide copies to the parties. (c) Parties to appear before the Sole Arbitrator on a date to be fixed by him at his earliest convenience.
(d) Fees payable to the Sole Arbitrator will be in accordance with the Bombay High Court (Fee Payable to Arbitrators) Rules, 2018.

The Arbitration Petition is disposed of in the above terms. 5.
No order as to costs.

The office to notify the Arbitrator of his appointment even by email.
7.
The Respondent's Advocate is permitted to file the affidavit in reply in the Registry.
