The Petitioner impugns order dated 30th August 2025 passed by the Civil Judge, Senior Division, Jaysingpur, Kolhapur below Exhibit14 in Hindu Marriage Petition No.91 of 2023, by which Application filed by the Respondent-wife under Section 24 of the Hindu Marriage Act,1955 seeking pendente lite maintenance has been allowed. 2.

Mr. Chetan Shine, learned counsel appearing for the Petitioner submits that the Respondent-wife is residing with her parents and, despite all efforts made by the Petitioner, she did not resume cohabitation. Therefore, the Petitioner has filed proceedings for divorce under Section 13(1)(ia)(ib) of the Hindu Marriage Act, 1955. Suresh 1/2

In this background, granting interim maintenance to her would amount to granting a premium to her conduct.

Having considered the submissions advanced and reasons recorded by Civil Judge, Senior Division, Jaisingpur, in impugned order, it can be observed that there is no dispute regarding matrimonial relationship between Petitioner and Respondent. 5.

It is not in dispute that Petitioner is a dentist and qualified medical practitioner. Although Petitioner contended that Respondentwife is serving as a teacher and earning Rs.1,00,000/-, evidence brought on record shows that she is earning only Rs.7,800/-. 6.

In this background, grant of interim maintenance at rate of Rs.10,000/- per month appears just and proper. The Trial Court has exercised jurisdiction within parameters of law. No jurisdictional error is brought to notice of this Court requiring interference under Article 227 of Constitution of India.
