Learned counsel for the appellants submits that though he called for urgent instructions regarding amicable settlement, he has not yet received any written instructions. He submits that his letter has been served upon appellant no.1, however, he has not responded. So far as letter issued to appellant no. 2 is concerned, the same is returned with postal remark "dead". He submits that he has no instructions with regard to heirs and legal representatives of deceased appellant no.2.

In view of aforesaid submissions, learned counsel for the appellants submits that he has no instructions to prosecute the second appeal further.

The Second Appeal is, therefore, dismissed for nonprosecution. 4.

In view of dismissal of second appeal, Civil Application No. 825 of 2017 is disposed of as infructuous.
