The State has preferred this application under Section 439(2) of Code of Criminal Procedure for cancellation of anticipatory bail granted to respondents vide order dated 18th April 2018 passed by learned Additional Sessions Judge, Jaisingpur. 2.
The respondents were apprehending arrest in CR No.53 of 2018 registered with Shirol Police Station for offences under Sections 363, 365, 341, 342 r/w 34 of Indian Penal Code. They preferred application for anticipatory bail which was allowed. While allowing the said application learned Additional Sessions Judge had observed MANISH SURESH THATTE MANISH SURESH THATTE Date: 2021.08.21 10:21:43 +0530 that there was pending litigation between parties. 3.
Learned APP submitted report forwarded by the concerned Police Station wherein it is stated that investigation was completed and charge sheet was filed on 9th June 2020. The report dated 13th August 2021 is taken on record. It is apparent that in view of filing
2 of 2 5.APPLN.553.2018.doc of charge sheet, the order passed by Sessions Court granting anticipatory bail was executed and the respondents were granted bail. Hence, in the aforesaid circumstances, prayers in this application cannot be granted and hence this application stands rejected.
