INTERIM APPLICATION NO.

By this application, applicant is seeking suspension of sentence and grant of bail.

It is contention of learned counsel for the Applicant that the applicant has been convicted by the learned Special Judge, (A.C.B.), Solapur in Special (A.C.B.) Case No.15 of 2018 vide order dated 15.09.2025 for the offence under Section 12 of the Prevention of Corruption Act, 1988 and sentenced to suffer rigorous imprisonment Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

for three years and to pay fine of Rs.5,000/- in default, to suffer simple imprisonment for 30 days. Learned counsel further submitted that during trial, the applicant was on bail. The learned Special Court has suspended the sentence till filling of the appeal and now the appeal is preferred, hence, requested for suspending the sentence. 3.

It is contention of learned APP that if sentence is suspended, the applicant may abscond. Hence, requested to reject the appeal. 4.

I have heard both the learned counsels, perused the impugned judgment and order. The sentence imposed on the applicant is short term. During trial, applicant was on bail and he has not misused the liberty. It may take time to dispose off the appeal. Considering these facts, I pass the following order.

ORDER

(i) The Interim Application is allowed;

(ii) The substantive sentence of imprisonment awarded to the applicant by learned Special Judge, (A.C.B.), Solapur in Special (A.C.B.) Case No.15 of 2018 vide order dated 15.09.2025 is hereby suspended pending disposal of appeal.

(iii) The applicant be enlarged on bail on furnishing PR bond in the sum of Rs. 15,000/- with one or two sureties in the like amount.

(iv) The bail bonds to be furnished before learned Special Judge, (A.C.B.), Solapur.

The interim application is allowed in the aforesaid terms and is accordingly disposed off.
