The Petitioner/husband impugns order dated 23rd May 2025 passed by Family Court, Kolhapur below exhibit-21 in Petition A-153 of 2021, by which he is directed to pay interim maintenance of Rs.13,000/- per month to his wife and son from the date of Application.

The learned advocate appearing for Petitioner submits that already in D.V. Case No.12/2019, maintenance order is passed by learned Judicial Magistrate First Class, Kolhapur and Respondent is already receiving maintenance of Rs.4,000/- pursuant to that order. However, no adjustment is made in that regard. Suresh 1/2

The aforesaid contentions appear to be fallacious. The Family Court has specifically taken note of interim maintenance of Rs.4,000/- granted under provision of Domestic Violence Act, 2005 and after considering Petitioner's income granted additional interim maintenance of Rs.13,000/- per month. It can be observed that Petitioner is employed as a Team Leader at Zensar Technologies and his salary for March 2024 was Rs.1,38,433/- and after deducting he was getting monthly income of Rs.1,15,069/- in his hand. In this backdrop, interim maintenance amount granted by Family Court cannot be said to be excessive and exorbitant. Hence, no case is made out to cause interference under Article 227 of Constitutions of India.

In result, Writ Petition stands rejected.

It appears that proceeding in A-153/2021 is pending before Family Court since 2020. The Family Court shall endeavor to decide same expeditiously and in any case within a period of one year from date of this order.
