At the outset the learned counsel appearing for the Appellant seeks leave to amend the prayer clause (b). Leave granted. Amendment to be carried out forthwith.

This Application is filed with a prayer that Criminal Appeal No.47 of 2017 may be separated and directions may be issued to the Registry to register the separate Appeal Number in respect of the Appeal proposed filed by lgc

(20) cri.IA-3438.21.odt the present Applicants i.e. original Appellant Nos.3 and 4. Mr. Priyal Sarda, the learned counsel appearing for the Applicants submits that advocate Mr. Tejas P Hilge has no objection for separating the appeal on behalf of original Appellant Nos.3 and 4 in Criminal Appeal No. 47 of 2017 and to represent the said Appellant Nos.3 and 4 by advocate Priyal Sarda.

In that view of the matte, the Interim Application No. 3438 of 2021 is allowed in terms of prayer clauses (b) ad (c) and accordingly permission to file separate appeal on behalf Appellant Nos.3 and 4 is granted so also advocate Mr. Priyal Sarda is permitted to represent the Appellant Nos.3 and 4. Registry to complete the necessary formalities as expeditiously as possible to separate the appeal. Needless to observe that upon presenting such an appeal on behalf of Appellant Nos.3 and 4, the Registry shall take further steps in accordance with relevant procedure.

The Interim Application No.3438 of 20221 is accordingly disposed of.
