By this civil application, the applicant seeks condonation of one year and 166 days delay in filing the civil application and seeks setting aside of abatement of appeal and seeks impleadment of the legal heirs of the respondent no.1. No affidavit in reply has been filed, though served.

Though the applicant has rendered some reasons in the civil application, in my view, interest of justice would be met with if the applicant is directed to pay costs of Rs.2,500/- as a condition precedent to Kirtikar Law Library within four weeks from today. Learned counsel for the applicant states that his client would donate a 1/2
41-cas628-14 sum of Rs.2,500/- to the Kirtikar Law Library within four weeks from today and and shall produce a receipt thereof before the Registrar of this court.

The civil application is accordingly disposed of in terms of prayer clauses (a), (b) and (c) on the condition that the applicant donates the said amount of Rs.2,500/- with the Kirtikar Law Library, as agreed within the time prescribed.

The civil application is accordingly disposed of in aforesaid terms. No order as to costs.
