Heard learned counsel for the Petitioner.

We have heard Mr. Shetye, learned counsel for the RespondentM.P.C.B., who seeks some time to take instructions; However, we do not see any reason to keep this Petition pending. The Petitioner has prayed for a direction to the Respondent-M.P.C.B. to consider the Petitioner's reply dated 6th December 2024 and to take a decision on the Petitioner's cause for seeking permission to restart the stone crusher unit. osk 1 of

Mr. Shetye submitted that, the N.G.T. has directed the closure of the unit. Certain conditions have been imposed by the N.G.T. which the Petitioner will have to comply with.

It is the submission of Mr. Shetye that the Petitioner was not compliant with the conditions mentioned in the Circular and hence, the N.G.T. has passed the order.

Learned counsel for the Petitioner submitted that by the replies dated 31st August 2024 & 6th December 2024, which are at page Nos. 36 & 44 of the paperbook, it has been clearly stated that the Petitioner fulfils the guidelines and the conditions set out in the said Circular. 6.

In such view of the matter, the Respondent - M.P.C.B. may consider the replies, which are at page Nos. 36 & 44 of the paperbook and if the Petitioner complies with the conditions mentioned in the said Circular, necessary directions to restart the unit be issued. The decision be taken within a period of four weeks from the date of communication of this Order.

Petition is disposed of.
