Ms. Veera Shinde, APP for the State.

PN. S. S. Mhamale, Dahiwad Police Station.

------ CORAM :

SHIVKUMAR DIGE, J.

DATE :

7th NOVEMBER, 2025 P.C.:

1.

By this application the applicant is seeking interim bail in crime no. 85 of 2025 registered with Dahiwad Police Station, District-Satara for the offences punishable under Sections 103, 238 and 61(2)(a) of Bharatiya Nyay Sanhita, 2023. 2.

It is the contention of learned counsel for the applicant that the application is 9 month's pregnant woman and her condition is extremely delicate. She may not get required

facilities in the Government Hospital. Learned counsel further submits that the applicant has filed an undertaking that she will surrender before the Jail Authority after a period of three months. Hence, requested to allow the application. 3.

Learned APP along with learned counsel for the intervenor strongly objected to allow the application on the ground that all the facilities which applicant is required, are available in the Government Hospital. The applicant is main culprit. She has committed murder of the deceased. If the applicant released on bail she may seek extension of bail on one and other pretext and requested to reject the application. 4.

I have heard all learned counsel. Perused FIR and documents produced on record.

5.

Admittedly, the applicant is 9 month's pregnant. Due to her delicate condition she wants delivery to be done in private hospital. Considering this fact and considering the undertaking given by the applicant, I pass the following order.

ORDER
