By this application, applicant is seeking regular bail in Crime No.386 of 2024 registered with Ratnagiri Police Station,District: Ratnagiri for the offences punishable under Sections 109, 3(5) and 238 (B) of the Bharatiya Nyaya Sanhita, 2023 (for short "BNS"). 2.
It is prosecution's case that on 10.10.2024, the applicant and coaccused assaulted the first informant on his neck with an intention to kill him. It is the contention of learned counsel for the applicant that the applicant is a lady and she is behind the bar for more than 14 ZIP 1/3
months. Investigation is completed. Charge-sheet has been filed and requested to allow the bail application.

It is the contention of learned APP that the first informant had suffered injury to his neck. He was unable to speak. If the applicant is released on bail, she may abscond and requested to reject the application.

I have heard both the learned counsel. Perused the FIR and documents produced on record.

The applicant is a lady and she is behind the bar for more than 14 months. Investigation is completed. Charge-sheet has been filed. Considering this fact, I pass the following order :
ORDER
I.
Application is allowed;
II.
The applicant be enlarged on bail in Crime No.386 of 2024 registered with Ratnagiri Police Station,District: Ratnagiri for the offences punishable under Sections 109, 3(5) and 238 (B) of the Bharatiya Nyaya Sanhita, 2023, on executing P.R.Bond in the sum of Rs.20,000/- with one or two sureties in the like amount.
III. The applicant shall not tamper with the evidence or ZIP 2/3
attempt to influence or contact the complainant, witnesses or any person concerned with the case. IV.
Applicant shall attend the Trial Court dates, regularly. 6.
The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
