Heard the learned counsel for the applicant and the learned counsel appointed to represent the respondent No.2.

Mr. Patil fairly submitted that as of today prayer clause(a) does not survive and has become infractuous. He further submitted that in view of Section 357(2) of the Cr.P.C. the prayer clause (b) also does not survive. Application is disposed off as infractuous.
