Heard learned counsel for parties.

The Petitioner is seeking a writ of mandamus to the Respondents to transfer the Petitioner from one district to another district in view of the Government Resolution which has been placed on record. Government Resolution enumerates certain categories where special consideration can be given for the inter district transfer. The documents which the Petitioner has annexed do not indicate that the Petitioner falls in this category. 3.

Learned counsel for the Petitioner states that the Petitioner Y.S.Patil

2 13-WP-1247-2024.doc has additional material to show that the Petitioner falls in this category. For that purpose the Petitioner will have to place the same before the concerned authority, calling upon them to pass necessary order on the application and thereafter appropriate relief can be sought.

Therefore we dispose of the Writ Petition giving opportunity to the Petitioner to make a fresh application placing on record necessary medical certificates etc. demonstrating how the Petitioner falls in the category enumerated in the concerned Government Resolution. If the concerned authority finds that Petitioner's claim is justified, then the authority shall pass necessary orders at the earliest within a period of 8 weeks, after the application is received subject to other pressing public duties. Whether the Petitioner is eligible for transfer or not is a decision we leave to the concerned authority to take.
