The Respondent/Commissioner-Administrator of Kolhpaur Municipal Corporation has filed Affidavit in Reply. In paragraph No.2 an unconditional apology is tendered and explanation is offered for delay in complying order.

The Affidavit states that total 248 employees were given benefits of difference of pay scale as per 6th Pay Commission from 1st January 1996 which amounts to Rs.1,09,06,829/- and other 34 Gaikwad RD 1/2
907-cp-587-2025.doc employees have been granted benefits of ACPS Scheme which amounts to Rs.22,65,754/-. The 32 employees, who have either attained age of superannuation or passed away prior to 1st January 1996 are not extended benefit of order of this Court. The 12 employees working on daily wages as on 1st January 1996 are also not given benefit of order of this Court. The affidavit further states that amount of Rs.15,20,950/- has been kept as reserved fund and same would be disbursed after getting details of legal heirs of employees, who have passed away after 1st January 1996, but information of heirs is not available. Apparently, there is compliance of order under contempt.

In that view of matter, Contempt Petition stands disposed of with liberty in favour of individual employee to make representation to Corporation, in case, they believe that order passed by this Court is not complied with.
