Considering the prayers made in the Petition, we deem it appropriate to dispose of the Petition at admission stage. 3.

It is the contention of the Petitioners that the land which is located in Gat No. 47 situated at Village, Amba Taluka-Shahuwadi, District-Kolhapur was acquired by the Respondent-State for the purpose of Manoli Rehabilitation of project afected person of Manoli project.

The Petitioners further submit that Rs. 1,44,618/- have been awarded to the Petitioners. The Petitioners would further submit that in the year 2003, the Respondent Authorities have disbursed only 50% amount out of the awarded amount and balance 50% amount is not yet disbursed to the Petitioners.

On 30th March, 2016 the Petitioner lodged representation to The Sub-Divisional Oicer, Panhala Sub-Division, District Kolhapur, requesting to release balance 50% of the award amount in their favour. However, till date, no action has been taken nor any response has been provided by the Respondent-Authority.

In view of this, the Petitioner seeks that Respondent-Authority be directed to consider the representation of the Petitioner and disburse the balance award amount as expeditiously as possible. 7.

Mr. Naik, learned AGP would submit that in view of the facts stated by the Petitioners, suitable orders may be passed. 8.

Considering the prayers made in Petition and upon hearing the parties, we pass the following order:

::ORDER::

A] The Writ Petition stands partly allowed.

B] The Sub-Divisional Oicer, Panhala Division, Kolhapur would consider the representation iled by the Petitioner on 30th March 2016 whereby the Petitioners have sought disbursement of the balance amount against the award dated 30th September 2002 bearing no. bhusampadan S. R./5/99 issued by the Sub-Divisional Oice, Karvir Division, Kolhapur. C] The Sub-Divisional Oicer, Panhala Sub-Division, would immediately initiate proper proceedings and would release such amount to the Petitioners within a period of 16 weeks from today if not already paid. If there is any legal impediment to granting the balance amount claimed by the Petitioner, the concerned Authority, namely the SubDivisional Oicer, Panhala Sub-Division, shall call upon the Petitioner and explain the nature of such impediment. D] In case the SDO negates Petitioners' representation, all Petitioners are at liberty to assail the same. All contention kept open.
