Mr. Akshay Kulkarni, learned Advocate for petitioner, fairly concedes that in view of decision of Division Bench of this Court in case of Jagdish Pitamber Pawar Vs. Pitamber Pundalik Pawar & Ors., reported in 2023 SCC OnLine Bom 3287, petitioner has an alternative remedy of filing an appeal under Section 16 of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 2.

In that view of matter, he seeks permission to withdraw present writ petition with liberty to approach Appellate Authority. ADN

Interim protection granted to petitioner by order dated 20th November 2025 shall remain in force for a period of four weeks from date of this order, to enable petitioner to approach Appellate Authority.

Needless to state that time spent in prosecuting pr2esent writ petition shall be taken into consideration for purpose of limitation, if appeal is filed within a period of four weeks from today. Appellate Authority shall endeavour to decide appeal expeditiously and preferably within a period of eight weeks from date of appearance.

Writ Petition stands disposed of.
