Present writ petition takes exception to order dated 30th September 2025 passed by Respondent No.4 - Sub-Divisional Officer, Madha, Kurduwadi Division, whereby order granting adinterim stay to order dated 21st July 2025 passed by Respondent No.3 - Circle Officer, Nimgaon (T), Taluka Madha, District Solapur, has been vacated.

Petitioner filed an appeal before Sub-Divisional Officer assailing order dated 21st July 2025 passed by Respondent No.3, thereby allowing mutation of names of private respondents in record of rights. The Sub-Divisional Officer was pleased to pass

interim order and stayed order dated 21st July 2025 passed by respondent No.3. However, on 30th September 2025 stay order has been vacated.

It appears that order dated 21st July 2025 passed by Respondent No.3 is already implemented and Mutation Entry No.4997 has been sanctioned.

In that view of the matter, without entering into merits of the contentions, it would be in the interest of parties if an innocuous order is passed directing Sub-Divisional Officer to decide Appeal No. RTS/SR/89/2025 within a period of eight weeks. 5.

In that view of the matter, the Sub-Divisional Officer, Madha, to decide Appeal No. RTS/SR/89/2025 within a period of eight weeks from today. Till decision of appeal, effect and implementation of Mutation Entry No.4997 shall be kept in abeyance.

Learned AGP to apprise this order to the concerned authority.

It is made clear that this Court has not delved into merits of the matter and all contentions are kept open.

The writ petition stands disposed of.
