Heard. This Application is for condonation of delay of 39 days in filing the appeal challenging the judgment and award dated 16/06/2012 passed by the MACT, Islampur in MACP Application No.26/2010.

The learned counsel for the Respondent vehemently opposed the Civil Application. He submits that the the Applicant has not made out any case for allowing the Civil Application. Same be dismissed with costs.

38.4240.12caf averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:
A) The delay in filing the appeal of about 39 days be condoned.
B) Civil Application stands disposed off accordingly.
