By this application, applicant is seeking regular bail in C.R. No. 183 of 2025 registered with Vairag Police Station, District Solapur for offences punishable under Sections 109, 118(2), 232, 118(1),
189(2), 190, 191(2), 191(3), 351(2), 251(3), 352 of Bhartiya Nyaya Sanhita, 2023.

It is the prosecution's case that on 31st May 2025, around 9.30 p.m., the applicants and co-accused assaulted the first informant with iron rod and fractured his leg and hand on the ground that they shall not depose as witness in the case pending against the coaccused. 3.
It is contention of learned counsel for applicant that The allegations against the applicant no. 1 are that applicant no. 1 assaulted on the left leg of the first informant with iron rod, but there is no injury on the left leg of the first informant. Learned counsel further submitted that the allegations against the applicant no. 2 are that he assaulted with wall pipe to the first informant. Applicants are behind bar for more than 6 months. Investigation is completed and charge-sheet has been filed. Hence, requested to allow the application.

It is contention of learned APP alongwith learned counsel respondent no. 2 that the applicants and co-accused assaulted the first informant with intention to kill him. In the said assault, the first informant has suffered fractured to his leg and hand. He is eye
witness to one criminal case where the co-accused are accused. If applicants are released on bail, it may demoralize the first informant. Moreover, after the assault, the applicants urinated on the face of the first informant. He further submits that the applicants assaulted the first informant with common intention. Hence, requested to reject the application.

I have heard all the learned counsel, perused F.I.R. and documents produced on record. The allegations against the applicant no. 1 are that he assaulted on the left leg of the first informant with iron rod. There is no injury on the left leg of the first informant. The allegations against the applicant no. 2 are assaulting with wall pipe. To prove the common intention of applicants, evidence is required. Applicants are behind bar for more than 6 months. Investigation is completed and charge-sheet has been filed.

In view of above, I pass following order:
O R D E R
I.
The Application is allowed.
II.
The Applicants be enlarged on bail in C.R. No. 183 of 2025 registered with Vairag Police Station, District Solapu on executing P.R.Bond in the sum of Rs. 20,000/- each with one or
two sureties in the like amount.
III.
The Applicants shall not tamper with the evidence or attempt to influence or contact the witnesses or any person concerned with the case.
IV.
The Applicants shall attend the Trial Court dates, regularly. V.
The applicants shall not enter in Solapur district till recording of evidence of the first informant.

The application is allowed in the aforesaid terms and is accordingly disposed off.

Intervention application is allowed and disposed off. 9.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
