Heard learned counsel for the Petitioner and learned APP for the Respondent - State.

Learned counsel for the Petitioner submits that the Petitioner was not involved in the offence as allegedly by the prosecution. It is further submitted that there are no allegations against the Petitioner regarding cheating, criminal breach of trust, or fabrication of documents, but the learned trial Court has not considered these facts. 109-WP-4594-2025 (CR).doc the submission of learned counsel for the Petitioner on these issue while hearing the matter, on instructions, seeks leave to withdraw this petition with liberty to raise the above issues before the trial Court. 3.

Considering the submission of learned counsel for the Petitioner and learned APP, the petition is allowed to be withdrawn. 4.

The trial Court is requested to consider the role of the Petitioner in the present crime on the basis of evidence produced on record.
