Though respondents are duly served, some of the respondents are remained absent when the matter is called out for hearing.

By this civil application, applicant/Insurance company is seeking condonation of 46 days delay in filing first appeal, challenging judgment and award dated 24.1.2017 passed by M.A.C..T, Satara, in M.A.C.P. No.65/2014 holding that respondents/claimants are entitled to sum of Rs.13,24,000/- by way of compensation alongwith interest @ 9% p.a. 4.

Considering submissions for ld.advocate for applicant, averments made in application, I am satisfied that applicant has made out a case for following order.

a) Delay in filing first appeal is condoned.

b) Civil application stands disposed of.

c) No order as to costs.
