Heard learned counsel for the petitioners.

We are informed that the respondent No.2 - Sub-Divisional Oicer, Solapur-1 (SDO, Solapur) had closed the Appeal for passing judgment sometime in February 2025. It is further submitted by the learned counsel for the petitioners that application for expediting the judgment was made on 28th October 2025. It has been quite sometime since the Appeal has been reserved by the SDO, Solapur for judgment. 3.

The judgment should have been delivered by now. However, we refrain from making any observations in view of the persuasive Uday S. Jagtap 1 of

931-12244-2025-CWP.doc argument of the learned AGP that every possible efort is being taken to deliver the judgment expeditiously.

We accordingly direct that SDO, Solapur to decide the Appeal within a period of 2 weeks from today. Learned AGP to communicate this order to the SDO, Solapur immediately. Learned counsel for the petitioner also assures that copy of this order will be placed before the learned SDO, Solapur by tomorrow.

Further, we ind that in the facts and circumstances of the present case, the petitioner is willing to deposit the entire penalty amount of Rs.7,50,525/- without prejudice to his rights and contention and recover the same by iling appropriate proceedings. 6.

We direct that the JCB (MH-14AL-1928) be released forthwith upon depositing the entire penalty amount of Rs.7,50,525/-. We make it clear that said deposit will be without prejudice and subject to the inal outcome of the Appeal and / or in any further proceedings in a challenge thereto if the order is adverse.

The Writ Petition is disposed of.
