Petitioner takes exception to order dated 12 September th 2025 passed by District Judge-2, Satara in Miscellaneous Appeal No.121 of 2023. Prima facie, it can be observed that petitioner is not yet a party to suit, and his application for impleadment is pending before Trial Court.

Mr. Anvil Kalekar, learned Advocate for petitioner, expressed apprehension that observations made in impugned order may come in his way if he is added as party to suit. This Court cannot countenance such submission. However, it can be observed that if petitioner is added as party to suit, he shall be entitled to file independent written statement/counter-claim, if any, in accordance with law.

In that view of matter, Writ Petition stands disposed of with liberty and observation in favour of petitioner.. 4.
