It is the grievance of Petitioners that on the basis of complaint made by a third person, the Education Oicer has directed the management to take action against the Petitioners and there is possibility that the management may suspend the Petitioners. 3.
It needs no mention that any order for initiation of proceedings or action of suspension has to be in accordance with the provisions of Maharashtra Employees of Private Schools (Conditions of Service) Patil-SR 1 of
925-WP-12756-2025.doc Regulation Act, 1977 and the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981. If the action of management is not in accordance with the provisions of law, it is always open for the Petitioner to challenge such action before the competent forum / authority / Court. Petition, as iled, is premature. 4.
Moreover, we ind that Petitioners have been involved in criminal ofence punishable under Sections 303(2), 305(d), 3(5) of BNS 2023 read with Sections 3 and 7 of the Essential Commodities Act, 1955. Learned Counsel for the Petitioner submitted that Petitioners were immediately released on bail and they have been falsely implicated. 5.
In our opinion, the petition is premature. Therefore, liberty is given to the Petitioner to approach this Court at a later stage if occasion so arises.
