The petitioner has sufered rejection of his nomination form for the general election pertaining to the Satara Municipal Council. 2.

Mr. Ghadge, learned counsel for the petitioner would submit that the Returning Oicer has committed an error in rejecting his nomination candidature despite that there being no defect in his nomination. He submits that his nomination is it to be accepted. He Uday S. Jagtap 1 of

914-12415-2025-CWP=.doc further submits that his nomination was rejected on the reason that it was time barred.

Learned counsel, Mr. Shetye for respondent no.2 - State Election Commission would point out Rule 15 of the Maharashtra Municipal Council and Nagar Panchayat Election Rules, 1966 whereby statutory remedy of an appeal before the learned District Judge is provided. He points out that there is speciic statutory remedy available to the petitioner if the nomination is rejected.

In view of this, Shri. Ghadge, learned Counsel for the petitioner, on instructions, seeks permission to withdraw the present petition with liberty to approach the concerned learned District Court against the rejection of his nomination. Leave granted.

The Writ Petition stand disposed of. All contention are kept open.
