The learned Counsel for the Petitioner on instructions of the Petitioner who is present in the Court for withdraw of the Petition, with a liberty to approach lower Appellate Court for seeking modification in the order impugned to the extent for furnishing an undertaking that he is permitted to complete the finishing of the ground floor of the constructed premises, subject to the final outcome of the Suit.

If the Petitioner approached with such an undertakings, the Appellate Court is requested to deal with the same in accordingly.
