Amol @ Amar Vithal Shirsat v. The State Of Maharashtra And ORS
suresh 906-WP-4490.2015
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4490 OF 2015 Amol @ Amar Vithal Shirsat .... Petitioner Vs.
State of Maharashtra & Ors.
.... Respondents Mr. Priyal G. Sarda for the Petitioner.
Mr. D.P. Adsule, APP, for the RespondentState. CORAM: A.V. NIRGUDE, J.
DATED: DECEMBER 10, 2015 P.C:
1.
Perused the orders under challenge. The order passed by the Appellate Authority considered all the aspects of the case and reduced the rigours of the original order externing the petitioner from three Districts. The Appellate Authority ordered externment of the petitioner only from Solapur District for six months. I find no reason to interfere in the order. 2.
The learned counsel for the petitioner placed reliance on a Division Bench decision of this Court in the case of
suresh 906-WP-4490.2015 Rama s/o Bapurao Gujar v. The State of Maharashtra & Ors., reported in 2014 All M.R. (Cri.) 938. Having regard to the ratio of this Judgment, the same does not appear to be applicable to the present case.
3.
The petition is dismissed.
