Heard learned Counsel for the applicant.

This application is for fixing early date of hearing of Second Appeal no. 705 of 2002 on the ground that applicant no.1A is senior citizen 82 years old. Office note shows that Second Appeal is not ready for final hearing as print is awaited. The learned counsel for the applicant submits that applicants are ready and willing to provide private paper book within four weeks from today. Statement is accepted.

14 cas 19-15=.doc learned counsel for the applicants and as one of the applicant is Senior citizen, I am satisfied that applicants have made out case for allowing Civil Application.

Hence, following order is passed:

a) Applicants are permitted to file private paper book within eight weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

b) filing of roznama and printing is dispensed with.

c) Hearing of Second Appeal no. 705 of 2002 is expedited in the list of senior citizen. d) Office is directed to place Second Appeal no. 705 of 2002 for final hearing in the weekly board in the list of senior citizen as per its turn, if, the matter is ready for final hearing. e) Civil application stands disposed off accordingly.
