The petitioner is original complainant. Vide order dated 11th December 2017 the learned Judicial Magistrate, Gargoti had directed that matter be put up for recording statement of complainant and his witnesses on oath vide Section 200 of Cr.P.C. Learned counsel for petitioner, on instructions, submit that petitioner would pursue the proceedings in accordance with order dated 11th December 2017. However, since proceedings are pending for long time, learned Magistrate may be directed to pursue with the proceedings expeditiously.

It is submitted that in the light of aforesaid submissions the petitioner would withdraw the petition. The petitioner would appear before Trial Court and pursue his complaint in accordance with order dated 11th December 2017 on any date as directed by this Court. 3.

In view of the submission, the petition is allowed to be withdrawn and stands disposed of. The petitioner shall appear before Trial Court on 11th July 2022 at 11.00 am along with this

2 of 2 37.WP.5504.2019.doc order. Learned JMFC, Gargoti shall proceed with the matter in accordance with order dated 11th December 2017 expeditiously. The petitioner shall co-operate with Trial Court in proceeding with the matter expeditiously and make available himself and the witnesses for examination. It is clarified that the petition has not been heard on merits.
