Learned counsel appearing for the Appellant states that there are written instructions of the Appellant - Hanmant Dattu Jadhav to withdraw the Second Appeal. The said written instructions dated 16th January 2023 are taken on record and marked 'X' for identification. Accordingly, Second Appeal is allowed to be withdrawn and dismissed as such.

In view of dismissal of Second Appeal as withdrawn, nothing survives in the Civil Application and the same is also accordingly disposed of.
