The Applicant is apprehending arrest in Crime No.690 of 2025 registered with Mangalwedha Police Station, Dist. Rural Solapur, for the offences punishable under Sections 74, 75, 119(1), 118(1), 115(2), 352, 351(2), 351(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

It is prosecution's case that on 1st September 2025, the applicant and co-accused outraged the modesty of the first informant and assaulted son of the first informant with wooden stick. 3.
It is contention of learned counsel for the applicant that the applicant has filed cross complaint against the first informant's ZIP 1/3
husband. The applicant has injured in the said attack. To counter the complaint of the applicant, the present complaint is filed. Considering the allegations against the applicant, custodial interrogation of the applicant is not required and requested to allow the application. 4.
It is contention of learned APP that the applicant and coaccused outraged the modesty of first informant and assaulted her son with intention to kill him. Considering the allegations against the applicant, his custodial interrogation is required and requested to reject the application.

I have heard both learned counsel and perused the FIR and documents produced on record.

It appears from the record that the applicant has filed counter case against the husband of first informant. The photographs produced on record shows that the applicant has injured in the said assault. The son of the first informant has not suffered any injuries. Considering these facts, custodial interrogation of the applicant is not required and I pass following order :

ORDER
(i) Application is allowed;
(ii) In the event of arrest, the applicant be enlarged on bail in Crime No.690 of 2025 registered with Mangalwedha Police Station, Dist. Rural Solapur, on executing P.R.Bond in the sum of Rs.20,000/- with one or two sureties in the like amount;
(iii) The applicant shall attend the concerned police station as and when required.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting anticipatory bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order. 3.
