At the outset, learned counsel for the applicants seeks leave IRESH MASHAL to withdraw the application so far as applicant no. 1 is concerned. by IRESH MASHAL Date:

Considering the submissions made by learned counsel for the applicants, application is dismissed as withdrawn so far as applicant no. 1 is concerned.

Applicants are apprehending arrest in C.R. No. 516 of 2025 registered with Sangli City Police Station for offences punishable under Sections 115(2), 118(1), 119(1), 189(2), 191(2), 191(3), 333, 352, 351(2) of Bhartiya Nyay Sanhita, 2023.

It is the prosecution's case that on 20th September 2025 at around 5.30 p.m. when the first informant and his wife were present in home, at that time, the applicants and co-accused came in their house and assaulted them with wooden stick, sickle and knife on the ground of financial dispute.

It is contention of learned counsel for applicants that the injuries suffered by the first informant and his wife are simple in nature. The counter case is filed by accused no. 2 against the first informant. Considering the allegations against the applicants, their custodial interrogation is not required and requested to allow the application.

It is contention of learned APP that the applicants and coaccused assaulted the first informant and his wife with wooden stick, sickle and injured them. There are two antecedents against the applicants. Considering the allegations against the applicants, their custodial interrogation is required. Hence, requested to reject the application.

I have heard both learned counsels, perused F.I.R. and documents produced on record. The injuries suffered by the first informant and his wife are simple in nature. Counter case is filed

against each other by both the parties. Considering the allegations against the applicants, their custodial interrogation is not required and I pass following order:

O R D E R

I.

Application is allowed.

II.

In the event of arrest, applicants be enlarged on bail in C.R. No. 516 of 2025 registered with Sangli City Police Station, District Sangli on furnishing P.R. Bond in the sum of Rs. 20,000/- each with one or two sureties in the like amount.

III.

The applicants shall attend the concerned police station as and when required.

IV.

The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

V.

Application is disposed of in above terms.
