Heard Mr. Raktade, learned Counsel for the petitioner and Ms. Kapre, learned A.G.P, for respondent Nos.1 and 2- State. 2.

Learned Counsel for the petitioner would submit that the petitioner is an Educational Institute which has admitted the students and imparted education to them them under the provisions of the Right to Education Act, 2009 (for short "the said Act"). He would submit that despite of giving admission to the students under the provisions of the said Act and having imparted education to these students within the four corners of the provisions of the said Act, the SHAILAJA SHRIKANT HALKUDE SHRIKANT HALKUDE Date: 2025.12.23 10:27:34 +0530

9-WP-12640-2025.doc respondents - Authorities have not yet released and reimbursed the amount payable to the petitioner in view of section 12 (2) of the Act. Learned Counsel for the petitioner would submit that directions be given to the respondents - Authorities to adjudicate the claim of the petitioner for reimbursement of 25% amount in view of section 12 (2) of the Act as expeditiously as possible.

In view of this, Writ Petition stands partly allowed. 4.

Respondent Nos. 2 and 3 shall scrutinize the proposal and claim iled by the petitioner seeking reimbursement of the amount under section 12 (2) of the said Act for a period from 2024-2025 and 20252026 within a period of eight weeks from today. 5.

Needless to mention that respondents shall give an opportunity of hearing to the petitioner in case, any deiciencies are noticed or any explanation is required.
