Though the respondents are duly served no one appeared on behalf of them when the matter called out. 3.
By this civil application, applicant-State of Maharashtra is seeking condonation of 112 days delay in filing First Appeal challenging the judgment and award dated 05.04.2010 passed by Civil Judge, Senior Division, Barshi, Dist. Solapur in L.A.R. No.481 of 2002. Considering the submissions made by learned AGP for applicant, averments made in civil application, I am satisfied that the applicant has made out case for following order :- S.C.Magar
64-caf-2031-2016.doc a) Civil Application is allowed in terms of prayer clause (B) which reads thus :- "(B) that this Hon;ble Court be pleased to condone the delay of 112 days in filing above mentioned First Appeal against the judgment and award dated 05.04.2010 passed by learned Civil Judge, Senior Division, Barshi, Solapur in L.A.R. No.481 of 2002;"
b) Civil application stands disposed of accordingly. c) No order as to costs.
