By this Petition under Article 227 of the Constitution of India, petitioners have challenged the judgment and order dated 04.11.2015 passed by the learned District Judge-1, Barshi in Civil Miscellaneous Appeal No.45 of 2015 as also the judgment and order dated 17.10.2015 passed by the learned Civil Judge, Senior Division, Barshi below exhibit-5 in Regular Civil Suit No.445 of 2013. Mr. Bodake has tendered photocopy of the order dated 05.12.2015 below exhibit-73, which is taken on record and marked 'X' for identification. 3.

Mr. Bodake submitted that by order dated 05.12.2015, the learned trial Judge has permitted petitioners / plaintiffs to withdraw the Suit and therefore, this Petition is rendered infructuous. 4.

In view of the above submissions, Petition is disposed as infructuous as the main Suit itself is withdrawn. Order accordingly. (R. G. KETKAR, J.) 1/1 Minal Parab
