Heard learned Counsel for parties.

By this Writ Petition, the Petitioner is challenging the decision taken by the Respondent rejecting the Petitioner's application for appointment to the post of Goods Guard, being land losers relative.

Learned Counsel for the Petitioner submits that the Respondents acquired Petitioner's aunt's Savitri Dhondu 1 / 3

Bagwe's land and issued land loser letter dated 25th September, 2009 (page 40 to the Petition). On the basis of said certificate Petitioner applied for employment. Learned Counsel for the Petitioner submits that the Respondents by their letter dated 25th January, 2016 rejected his application on the ground that the Petitioner is not relative of the said land losers i.e. Savitri Dhondu Bagwe.

During the course of arguments, it is noticed that the Petitioner is neither the son nor grand son of the said Savitri Dhondu Bagwe as required as per the Respondents policy for providing appointment of land losers relative and therefore, the Respondents rejected his application by order dated 25th January, 2016. It is also noticed that even the Petitioner's father's land also acquired and issued the land losers certificate dated 5th March, 2014 (page 35 to the Petition). 5.

The learned Counsel for the Petitioner submits that the Petitioner may be permitted to withdraw the Petition with liberty to file fresh application using his father's land losers certificate dated 5th March, 2014. To that effect learned Counsel for the Petitioner has given in writing. Same is taken on record and marked 'X' for identification.

Writ Petition stands disposed of as withdrawn with liberty as prayed. No order as to costs.
