This is an application for anticipatory bail in CR No. 419 of 2019. The ofence was registered with Karmala Police Station, District-Solapur, for the ofence punishable under Section 379 r/w 34 of Indian Penal Code and section 15 of the Environment Protection Act.

The case of the prosecution is that, on 24th June, 2019 the informant was on patrolling duty at village Kandar, one Tipper was accosted by him. The said Tipper was carrying three brass sand. The inmates of the vehicle could not produce any royalty receipts for the sand. The Tipper was

Rekha Patil 2 of 914-ABA-2418-2019.doc seized. The persons, who were carrying the sand, were arrested. One of them was the owner of the tipper. The sand was to be sold in the open market. It was revealed during the course of investigation that the sand was supplied by the applicant for which the consideration of Rs.17,000/- was paid to him. It is also alleged that the applicant had used his JCB to load the sand in the Tipper. Thus, investigation revealed the involvement of the applicant as a person supplying the sand. Apparently, the arrested accused could not produce any receipt to justify the transportation of the sand. In the circumstances, no case for anticipatory bail is made out. Hence, application needs to be rejected. Hence, the order as follows:-

ORDER

Anticipatory Bail Application No. 2418 of 2019 is hereby rejected.
