1) It is an admitted fact on record that, the Applicant, though a qualified Doctor had not obtained permission from any Government Authority to run a Pathology Laboratory, by name Jadhav Laboratory. 1.1) Despite asking the learned Advocate for Applicant repeatedly, to show any document, even to remotely suggest that, the Applicant was lawfully permitted to conduct and run a Pathology Laboratory under any law, he was unable to produce the same. The only contention raised on behalf of the Applicant is that, he is MD (Pathology) and therefore entitled to do anything under the law. We are not in agreement with the learned Advocate for the Applicant on this submission.
