Case pleaded in the Writ Petition is that during the pendency of Appeal No. 43 of 2013 before the learned Divisional Commissioner, in which Appeal the issue whether land of the Petitioner acquired was liable to be released from the acquisition, the notice dated 21st November, 2015 issued by the Circle Officer directing possession to be handed over be set aside and a direction issued that Appeal No. 43 of 2013 be heard expeditiously.

The response filed is that the Appeal No. 43 of 2013 has been dismissed vide order dated 30th June, 2017. 3.

Thus, the Writ Petition has been rendered infructuous and is disposed of as such.

The Petitioners would be entitled to remedy as per law against the appellate order.
