This Application is for condonation of delay in filing the Family Court Appeal challenging the judgment and decree dated 13th June 2016 passed by the Family Court, Kolhapur in Petition No.A­172 of 2013 allowing the Respondent - wife's counter­claim. 3.

Considering the submissions made by the learned counsel VRD

CAM275.17.sxw for the Applicant and the averments made in Civil application, we satisfy that the Applicant has made out a case for allowing the Application. At the same time, the Applicant has to pay Rs.5,000/­ as costs within four weeks from today. Hence the following order :­ "(a) The delay of 109 days in filing Family Court appeal is condoned.

(b) The Applicant to pay costs of Rs.5,000/­ to the Respondent within four weeks from today.

(c) If the costs is not paid within the stipulated time, Civil application shall stand dismissed without reference to the Court.
