The learned APP submits that the investigation is in progress. In view of this, learned Counsel for the applicant seeks liberty to withdraw the application with further liberty to approach the Sessions Court under section 439 of the Code of Criminal Procedure, 1973 in the changed circumstances. Liberty as prayed for is granted. The learned Sessions Court shall not be influenced by the withdrawal of this application and consider the application under Section 439 of the Code of Criminal Procedure, 1973 on its own merits.
