By this application, the applicant is seeking suspension of sentence and grant of bail.

It is contention of learned counsel for the applicant that applicant is convicted by learned Special Judge, Sindhudurg at Oros in Special Case No.13 of 2019 by order dated 27th June, 2022 for the offence punishable under Sections 376(2), 376-D, 506 read with

Section 34 of Indian Penal Code,1860 and under Sections 4, 8 and 12 of Protection of Children from Sexual Offences Act, 2012 and sentenced to suffer rigorous imprisonment for seven years and to pay total fine of Rs.2,800/- and in default to suffer further simple imprisonment for ten days. Learned counsel further submitted that the applicant is behind bar more than four years out of seven years punishment. He has undergone half of the sentence. It may take time to dispose off the appeal and requested to allow the application. 3.

It is contention of learned APP along with respondent no. 2 that the applicant is convicted by the Special Judge, Sindhudurg, Oros. If applicant released on bail, he may abscond and requested to reject the application.

I have heard all the learned counsel. Perused the impugned judgment and order passed by the Special Judge. 5.

The applicant is behind bar more than four years out of seven years punishment. He has undergone more than half of the sentence. It may take time to dispose off the appeal. Considering these facts, I pass following order :

ORDER

I.

The Application is allowed;

II.

The substantive sentence of imprisonment awarded to the

applicant by the learned Special Judge, Sindhudurg, Oros in Special Case No.13 of 2019 by order dated 27th June, 2022 is hereby suspended pending disposal of appeal. III. The applicant be enlarged on bail on furnishing PR bond in the sum of Rs.20,000/- with one or two sureties in the like amount.

IV.

The bail bonds to be furnished before the learned Special Judge, Sindhudurg, Oros.

The application is allowed in the aforesaid terms and is accordingly disposed off.
