Mr.Patil, learned AGP appearing for the applicant states that the respondent no.3 has expired on 7th September 2015 and has annexed a copy of the death certificate to the civil application. Names of the heirs of the deceased respondent no.3 are disclosed in paragraph 2 of the civil application. Civil application is filed within time. 2.

For the reasons recorded in the civil application, civil application is made absolute in terms of prayer clauses (a), (b) and (c). No order as to costs. Amendment to be carried out within two weeks from today. Amended copy of the second appeal shall be served upon the respondent nos.3A to 3C as well as the other respondents through their advocates within two weeks from today. R.D. DHANUKA, J.
