Heard Ms. Patil, learned Counsel appearing for the Applicant and Mr. Yadav, learned APP for the Respondent-State. 2.

The Applicant, who is the Accused No.2 is apprehending arrest in C.R. No.513 of 2023 registered at Solapur Taluka Police Station, Dist. Solapur for the offence punishable under Sections 188, 272, 273, 328 of the Indian Penal Code, 1860 and Sections 26(2)(iv), 26(2)(i), 26(2)(ii) and 27(3)(e) of the Food Safety and Standards Act, 2006.

Ms. Patil, learned Counsel appearing for the Applicant submits that the accused No.1 has been granted regular bail by the

order dated 26th September 2023 passed by the learned Additional Sessions Judge, Solapur in Criminal Bail Application No.1048 of 2023. Ms. Patil, learned Counsel further submits that the Applicant has been granted protection by a learned Single Judge by the order dated 26th October 2023 passed in this Anticipatory Bail Application and the said protection is continued from time to time and operating till date. She submits that the chargesheet has been filed on 10th October 2024. She submits that the Applicant has cooperated with the investigation and as the chargesheet is filed, investigation is completed. She therefore, submits that the custodial interrogation is not necessary.

On the other hand, learned APP strongly opposes the Anticipatory Bail Application. It is his submission that 45 gunny bags of R. K. Gutkha containing 6 bags each with 50 packets in each bag worth Rs.16,20,000/- are seized by the police. Therefore, the learned APP states that the Anticipatory Bail Application be rejected.

However, perusal of the record shows that the FIR has been lodged on 5th September 2023, the investigation has been

completed and the chargesheet has been filed on 10th October 2024 and the Applicant has been granted interim protection by the order dated 26th October 2023 and the said protection is continued till date. Therefore, almost two years the said protection has been continued.

Ms. Patil, learned Counsel appearing for the Applicant states that there are no antecedents against the Applicant. Learned APP, on instructions, confirms the said statement. 7.

Accordingly, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant in connection with C.R. No.513 of 2023 registered with the Solapur Taluka Police Station, Dist. Solapur, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.1,00,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 03:00

p.m. till the conclusion of trial.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

Accordingly, the Anticipatory Bail Application is allowed in the aforesaid terms and disposed of.
