The petitioner seeks expeditious consideration of the proceedings that are pending before the learned Joint Charity Commissioner under Section 47 of the Maharashtra Public Trusts Act, 1950. It is submitted that the said application under Section 47 came to be filed in January 2012.

It is further submitted that proceedings under Section 41D of the said Act came to be decided by the learned Joint Charity Commissioner on 30th November 2011. Being aggrieved by the said order, the petitioner has filed appeal under Section 41D(5) of the said Act. The learned District Judge on 16th February 2012 passed an interim order in the said appeal after which nothing further has happened in the matter.

Considering the fact that the proceedings under Section 47 of the said Act are pending before the learned Joint Charity Commissioner and Civil Miscellaneous Application No.91 of 2011 is pending before the learned District Judge, the writ petition is disposed of by directing expeditious consideration of both the aforesaid proceedings, if the same have not yet been decided. The learned District Judge as well as the learned Joint Charity Commissioner to expeditiously dispose of the respective proceedings in the light of the fact that the same are pending since 2012 and 2011 before them. All points raised are kept open. Order accordingly.
