By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.116 of 2022 registered with Pandharpur City Police Station, Solapur Rural, for the offences punishable under Sections 420, 419, 465, 467, 468, 471, 201, 34 of the Indian Penal Code.

It is argued that there are total four accused persons including Applicant out of which except Applicant other co-accused have been granted bail. It is pointed out that the Applicant is in jail from 20 th January 2023 i.e. for about one and half years. In the present matter charge sheet has been filed and allegations against the applicant is of cheating and fabrication of documents. Thus, considering the period of incarceration coupled with the maximum punishment and the allegations made in the FIR, I am of the opinion that further custody of the Applicant is not necessary.

Learned APP strongly opposed the application and pointed out

2 of 2 61.BA.3370.2023.doc that there are two similar offences committed by the Applicant. However, considering the nature of material in the present matter and the period of incarceration of the Applicant, I am of the opinion that Applicant is entitled for bail.

ORDER

(i) Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.116 of 2022 registered with Pandharpur City Police Station, Solapur Rural, for the offences punishable under Sections 420, 419, 465, 467, 468, 471, 201, 34 of the Indian Penal Code on furnishing P.R.Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount;

(iii) The Applicant shall attend Pandharpur City Police Station, Solapur Rural, on every 1st and 16th of every month between 10.00 am and 12.00 noon am till conclusion of trial; (iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; (v) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence;

(vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
