This writ petition has been filed assailing the Order-in-Original dated 17.03.2017 passed by the Deputy Commissioner, Central Excise and Service Tax Department, Kolhapur.

Today the writ petition is before us on a praecipe filed by learned counsel for the petitioner whereby he seeks withdrawal of the writ petition. The prayer has been made on the basis of instructions furnished vide letter dated 22.02.2021 written by the Chief Executive Officer, Phaltan Municipal Council.

Learned counsel for the petitioner submits that petitioner has opted for settlement under the Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019. Petitioner has already paid the amount as determined by the designated committee under the aforesaid scheme.

Learned counsel for the respondent has no objection to the prayer made for withdrawal of the writ petition. 6.
In that view of the matter, we allow the petitioner to withdraw the writ petition. Accordingly, the writ petition is disposed of as withdrawn.

The letter written by the Chief Executive Officer, Municipal Council of Phaltan dated 22.02.2021 is marked as Exhibit 'X' for identification and kept as part of the record. 8.
