We have heard learned counsel for the parties. We have also perused the earlier orders passed by a co-ordinate Bench of this Court in the present proceedings and more particularly, order dated 7th June 2023. 2.

Considering the facts and circumstances of the case, we are of the opinion that further adjudication of this petition is not warranted for the reasons that the issue as raised involves adjudication of the rights of three parties namely rights of the Petitioner vis-a-vis rights of the Mr.Vitthtal Sanghana Kamble and Mr.Sada Pisal who were in possession of the property.

As observed in the order dated 7th June 2023 passed by this Court, learned AGP had made a statement that the proceedings pending before the Divisional Commissioner, Pune are yet to be decided. 4.

Today, it is stated by Ms.Bane, learned AGP that she has

ppn 2 2.wp-825.2020.doc received communication from the Divisional Commissioner, Pune informing that before the Divisional Commissioner, hearing has already been concluded and now the Divisional Commissioner would pass an appropriate order within four weeks from today. We accept the statement made by learned AGP on behalf of the State.

Accordingly, the Divisional Commissioner shall pass an appropriate order within four weeks from today. The petition is accordingly disposed of in view of the statement as made by Ms.Bane. All contentions of the parties are expressly kept open to be agitated in appropriate proceedings. No costs.
