By the impugned order, the Trial Court has rejected an application under Order 18 Rule 17 of the Code of Civil Procedure, 1908. The order is interlocutory in nature capable of being challenged under Section 105 of the Code of Civil Procedure, 1908.

The writ petition accordingly stands dismissed with liberty to the petitioner to challenge the order in appeal in case the decree is against the petitioner.
