In crime No.171/2014 for offence punishable under sections 457, 380, 379, 382, 449, 452, 143, 147, 148, 149, 427, 120(B) of the Indian Penal Code and sections 37(1) A to F(3) and 135 of the Bombay Police Act registered with Peth Vadgaon police station, Kolhapur, the applicant is seeking pre­arrest bail. 3.

The offence alleged is of 2014.

In addition to above, the fact remains that the applicant is a public servant and very much available to the investigation agency. The applicant was never summoned in the aforesaid crime for last four years. In that view of the matter, the applicants are entitled for pre­arrest bail. Hence the order :­ i) In the event of arrest in Crime No.171/2014 for offence punishable under sections 457, 380, 379, 382, 449, 452, 143, 147, 148, 149, 427, 120(B) of the Indian Penal Code and sections 37(1) A to F(3) and 135 of the Bombay Police Act registered with Peth Vadgaon police station, Kolhapur, the applicant be released on bail on his executing P.R. bond of Rs.25,000/­ with one or two sureties in the like amount; ii) The applicant shall attend the Investigating officer as and when directed;

iii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;

iv) The applicant shall co­operate with the investigating agency; v) The application stands disposed of accordingly. (NITIN W. SAMBRE, J.)
